Ukraine surrogacy legislation:
law and judicial practice

Surrogacy is the voluntary consent of a woman (surrogate mother in Ukraine) to become pregnant through artificial insemination, carry and give birth to a child genetically alien to her for a couple (parents) who are medically unable to do so on their own. After giving birth, the surrogate mother immediately gives the child to its genetic parents.

Who can become a surrogate mother?

In Ukraine, a citizen of Ukraine who meets the following requirements can become a surrogate mother:
  • age from 19 to 36 years
  • must have given birth to their own healthy child/children, born either naturally or by cesarean section
  • positive Rh blood factor +
  • absence of severe chronic diseases
  • No dependence on tobacco, alcohol, or drugs

What financial reward does a surrogate mother receive for participating in the program?


The guaranteed payout amount starts from 21,500 euros.

The main payments consist of the following payments:

  • payment on the day of embryo transfer 300 euros
  • payment after confirmation of pregnancy 200 euros
  • monthly payment of 400 euros
  • payment at 28 weeks of pregnancy 1800 euros
  • payment after the birth of a child 16,000 euros

All payments are made in euros, so the surrogate mother does not need to worry about currency fluctuations.

Additional payments:
  • surcharge for cesarean delivery (the decision is made by the doctor) 2000 euros
  • additional payment for the birth of twins 2000 euros

Guaranteed bonuses:
  • compensation for all transportation costs associated with arrival at the hospital
  • purchase of clothes for pregnant women starting from the 12th week, taking into account the time of year

How to become a surrogate mother in Ukraine?


The surrogacy program consists of several main stages:
Stage 1 Contact of the woman (surrogate mother candidate) with the medical coordinator.
At this stage, the woman is interviewed over the phone. If the woman meets the primary requirements for the surrogacy program, she is provided with full information about the terms of the program, the price of remuneration, rights and obligations. After agreeing on all the important issues, the woman will make an appointment at the clinic.

Stage 2 Free consultations with specialized specialists and medical examination
At this stage, the woman will undergo a free full medical examination, including transvaginal ultrasound (ultrasound), vaginal swabbing to determine the microflora, blood sampling to exclude HIV, AIDS, hepatitis B, C, A, examinations by a gynecologist, therapist, mammologist, and psychologist.

Step 3 Conclusion of a written notarized agreement
After a medical examination and approval of the candidate for the surrogacy program, a contract is signed between the surrogate mother and the biological parents.

The agreement clearly sets out all the terms of the program, the rights and obligations of the participants, the amount of remuneration, and the procedure in case of force majeure (e.g., miscarriage). The agreement is subject to mandatory notarization.

Stage 4 Preparing a surrogate mother for artificial insemination
At this stage, the woman will prepare for the transfer of the embryo into the uterine cavity. For this purpose, it is necessary to take medications for 10-14 days according to the schedule determined by the doctor in order to minimize the risk of embryo rejection.

Stage 5 Transfer of embryons
The procedure of embryo transfer is performed during the most favorable phase of the menstrual cycle for fertilization. Usually, 2 embryos are transferred, since the probability of embryo survival is 50%. The probability of survival of 2 embryos at the same time is about 30%. Embryo transfer is a painless and simple procedure that is performed without anesthesia. IVF technology is used for this purpose

Stage 6 Confirmation of pregnancy
On the 14th day after the embryo transfer, a woman takes a blood test for pregnancy. The blood test shows the presence of the hormone hCG (human chorionic gonadotropin) in the woman's body, which is produced during pregnancy. If pregnancy does not occur, the procedure with embryo transfer is repeated again.

Stage 7 Pregnancy and moving into clinic-provided housing
During pregnancy, the surrogate mother undergoes ultrasound examinations, screenings, cow and urine tests, as well as tests for the presence of alcohol, drugs, traces of smoking in the body, all of which are carried out with the aim of giving birth to a healthy child.

The doctor is in contact with the surrogate mother 24/7, and in case of any questions or problems, the woman should immediately inform the doctor.

At the 30th week of pregnancy, the surrogate mother moves into a free apartment that is close to the clinic where the birth will take place.

Stage 8 Childbirth
The birth takes place in a pre-determined clinic. Immediately after the birth, the surrogate mother is paid the final amount of remuneration for participating in the program.

The surrogacy program also includes postpartum support for women, which includes free consultations with gynecologists and psychologists for several months, if necessary.

Frequently asked questions about surrogacy

How long should a woman take after giving birth?


To be eligible to participate in the program, at least 10-12 months must have passed since the last delivery


Is it possible to become a surrogate mother after a cesarean section?


Yes, cesarean delivery is not an obstacle to surrogacy, provided that the woman has no health contraindications.


Is the husband's consent required for a woman to participate in a surrogacy program?


For example, if a woman is officially married, her husband's written consent to his wife's participation in the surrogacy program is required. If the marriage is dissolved, a divorce certificate will be required.


Is it possible to continue nursing your child and become a surrogate mother?


No. At the time of entering the surrogacy program, a woman must have completed the period of breastfeeding. This is because the lactation period is not favorable for artificial insemination.


Why is it possible to become a surrogate mother only by the age of 36?


A woman's age is of fundamental importance for a surrogacy program. A woman under the age of 36 is in the most favorable time for a safe pregnancy and childbirth. It is critical for both the woman and the child to have a comfortable pregnancy and childbirth without any possible complications.


How long does it take to prepare for a surrogacy program?


It will take about 14 days to complete a full medical examination and receive the results of laboratory tests. After that, the doctor makes a decision on whether to approve the candidate for the surrogacy program.


Where should a surrogate mother live during the program?


Until the 30th week of pregnancy, the surrogate mother stays at her place of residence. Starting from the 30th week, the woman moves to a free apartment provided by the clinic. She can choose to live with her children and husband or in a two-room apartment with another surrogate mother. For safety reasons, there must be 2 adults in the room.


Is it necessary to conclude a surrogacy service agreement?


Yes. A written notarized Agreement is concluded between the surrogate mother and the biological parents. This will be the main legal document that will regulate the relationship between the surrogate mother and the biological parents.


Can a surrogate mother keep a child who is genetically alien to her?


No. According to the current legislation, a surrogate mother has no parental rights in relation to the born child and is obliged to give the child to its genetic parents. According to Part 2 of Article 139 of the Family Code of Ukraine, a surrogate mother is deprived of the right to challenge maternity in court.

In accordance with the current legislation, a surrogate mother is guaranteed complete confidentiality. Participation in the program is a medical secret and is not subject to disclosure

Support of a personal medical coordinator 24/7


Once a woman is approved for the surrogacy program, she will have a personal medical coordinator. The woman will be able to call or write to the coordinator 24/7 for medical or psychological support.
In turn, the coordinator will keep in constant contact with the surrogate mother: ask how the woman is feeling, remind her of scheduled visits to the hospital, and inform her of the results of laboratory tests.
